1. ACCEPTANCE OF TERMS
1.1 Agreement to Terms
By accessing, registering for, or using the Anicetus X Video Platform ("Platform," "Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.
1.2 Entity Definitions
- "Anicetus X" refers to the AI-powered video content creation and distribution platform operated by Anicetus Agentic Systems.
- "User," "you," or "your" refers to any individual or entity accessing or using the Platform.
- "Content" refers to any videos, scripts, images, audio, text, or other materials created, uploaded, or distributed through the Platform.
1.3 Age Requirements
You must be at least 18 years old to use this Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
1.4 Modifications
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform following any changes constitutes acceptance of the modified Terms.
2. DESCRIPTION OF SERVICES
2.1 Platform Services
Anicetus X provides AI-powered video content creation services, including but not limited to:
- AI-generated video creation using text-to-video models
- Script writing and content ideation
- Avatar and voice cloning services
- Social media distribution and scheduling
- Analytics and performance tracking
- Multi-platform content optimization
2.2 Subscription Tiers

2.3 Service Availability
While we strive for 100% uptime, the Platform is provided "as is" and "as available." We do not guarantee uninterrupted, timely, secure, or error-free service. Scheduled maintenance will be announced at least 24 hours in advance when possible.
3. ACCOUNT REGISTRATION AND SECURITY
3.1 Account Creation
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
3.2 Account Security
You are responsible for keeping your password secure and confidential, notifying us immediately of any unauthorized account access, ensuring all account information remains accurate, and all actions taken under your account.
4. PAYMENT TERMS
4.1 Billing
- Subscription fees are billed monthly in advance
- All prices are in South African Rand (ZAR) and inclusive of VAT where applicable
- Payments are processed through Paystack Payment Gateway
- You authorize us to charge your selected payment method
4.2 Recurring Billing
By subscribing, you authorize recurring charges to your payment method. Charges will occur on the same date each month (or nearest business day).
4.3 No Refunds for Partial Months
Except as outlined in our Refund Policy, subscription fees are non-refundable for partial months or unused portions.
5. INTELLECTUAL PROPERTY RIGHTS
5.1 Platform Ownership
All rights, title, and interest in the Platform, including software, algorithms, AI models, user interface, trademarks, and documentation remain the exclusive property of Anicetus X and its licensors.
5.2 AI-Generated Content Ownership
Subject to third-party rights, you own the AI-Generated Content created using your account. We retain the right to use anonymized outputs for model training and improvement.
5.3 Third-Party Rights in AI Content
You acknowledge that AI-Generated Content may incorporate or resemble third-party works. You are responsible for ensuring your use does not infringe third-party rights.
6. USER CONDUCT AND PROHIBITED ACTIVITIES
6.1 Prohibited Content
You may not create, upload, or distribute Content that:
- Is illegal, fraudulent, or promotes illegal activity
- Infringes intellectual property rights
- Is defamatory, libelous, or invasive of privacy
- Contains hate speech, harassment, or discrimination
- Is sexually explicit, pornographic, or obscene
- Promotes violence, terrorism, or self-harm
7. DATA PRIVACY AND PROTECTION (POPIA COMPLIANCE)
We collect and process personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA) and our Privacy Policy.
8. DISCLAIMER OF WARRANTIES
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We specifically disclaim all warranties regarding AI-Generated Content, including accuracy, completeness, originality, and fitness for any particular purpose.
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANICETUS X SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Our total liability for any claim shall not exceed the greater of the amount you paid to us in the 12 months preceding the claim or ZAR 1,000.
10. TERMINATION
10.1 Termination by You
You may terminate your account at any time by canceling your subscription in account settings or requesting account deletion via support.
10.2 Termination by Us
We may suspend or terminate your account immediately for material breaches of these Terms, with 30 days' notice for non-material violations, or upon your failure to pay fees when due.
11. GOVERNING LAW AND DISPUTE RESOLUTION
11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa.
11.2 Arbitration
If informal resolution fails, disputes shall be resolved through arbitration in Johannesburg under the rules of the Arbitration Foundation of Southern Africa (AFSA).
